The terrorists at Gitmo lack US citizenship and they are "not" on American soil (Gitmo is on land leased to the USA shortly after the Spanish American War in 1898 and renewed by the Cuban government at a later date). I fail to see how the laws designed to protect "us" on American soil would apply to "them" on foreign soil.

Habeus corpus gives words meaning? Or the ability to face your accusers. So what about the 432+- children and their families. Is this going to make a difference in the way the government takes action to AMERICAN citizens, or will the childrens be able to face their accusers. Words, accusations, where are the accusers?

The Constitution exists to protect US citizens on US soil. Gitmo holds no US citizens and isnt on US soil. So the detainees aren't under its protection.

Giving the police the power to lock up anybody suspected of being a terrorist who they don't have enough evidence to charge, effectively means they can lock up anyone they want. It means you, your gran, anyone at all. Mahatma Gandhi and Nelson Mandela were labelled terrorists and locked up. Mandela has been on the terrorist list in the USA up till this year. An 82-year old labour party member was arrested under the Anti-Terrorism act in the UK for saying "Nonsense!" at a Labour party speech.

It doesn't matter if it's on U.S. soil.
These rights, according to the constitution, were given to us all by God. "...endowed by our creator...with certain inaliable rights,".
That means everybody is born with them, having been given them by God, but only some countries recognize them. America doesn't give these rights, we recognize them, and indeed even fight wars for them. It doesn't matter where your born, or what you did.

You are quoting the Declaration of Independence. You know that our laws are not based or enforced from the DOI right? They are derived from the US Constitution. The Constitution pertains to "Our" laws and how "Our" people are too be treated.

If they do not have the evidence to charge someone with US citizenship they will be forced to release them. In the US we have the right to a speedy trial. If you aren't a US citizen sucks for you.
