Actually, the real reason the Torch wasn't in this show is because the legal rights to his character were tied up in a live action movie that never ended up being completed.
The story of the censors worrying about kids setting themselves on fire is an urban legend.

According to the storyline in the June 1979 issue of the Fantastic Four Comics. Johnny was "late" for the tryouts auditions for the DPE Films version of the Fantasic Four (which starred Ted Cassidy "Lurch" of the "Addams Family" Frank Welker) was replaced with H.E.R.B.I.E. the story within the storyline was a clever plug for the new F.F. show that premiered in the fall of 1979.

There was a copy right conflict envolving Johnny Storms Human Torch and the golden age Human Torch who was a member of the Invaders alongside Captain america and Namor in the fourties instead of using an exsisting hero like She Hulk or creating someone useful they went with comic relief in the form of H.E.R.B.I.E. by the way this same conflict is why Firestar premiered on Spiderman and his Amazing friends instead of JohnnyStorm as originally intended.
