There is much to be said about our driving laws, but the one that really is wrong is the idea that a person must have a drivers licence in order to opperate a motor vehichle on our highways. They tell us that driving is a privilage. Well, it's not, its a right. We have the freedom of mobility what ever the mode of transpotation is for the day. The Motor vehichle Dept. is nothing more that a clearing house for idenifiying all citizens on a national basis.

Ok, well all this appeal stuff is nice but let's look at the definition of the word "vehicle" from the statute that you were charged under. At the very end it says "other than a BICYCLE that is moved by human power" So, what else happened, what's the TRUTH?

since he is talking about statistics being wrong, 36,000 people a year do not die from the flu. If you look on the CDC website you will find on average less than 1300 die a year from the flu.

He's only talking deaths. Injuries, paralysis, $ losses? My friend, a poor, single mom student, was run off road by a drunk. She spent 1 day in hospital, but was in pain for weeks. Car was totaled, and the drunk didn't have any $ or insur. Now my friend is in debt for a car she couldn't afford and delayed graduation for a semester. Be honest. What are the numbers of people whose lives have been turned upside down by drunken libertarians? Cry ur alcoholic tears on Ron Paul's lapel.

Driving is NOT a right, it is a privilege. That's why they say your driving privileges are revoked, not your driving rights. Anybody who gets behind the wheel of a car for any reason after drinking any amount of alcohol is abusing their privilege. It's called designating a driver, calling a cab, or taking the bus! To even sugest that not having the "right" to mix drinking with driving is "repressive" isn't just ignorant or stupid, it's dangerous. Think US laws are tough? Go to Germany sometime.

Drink driving is idiotic but pushing a bicycle isnt drink driving in any realm of reality. IT would be different if this guy was riding it, but pushing it under the influence of alcohol was actually the right sane and reasonable decision, i cant believe this happened to him!!

i dont drink alcohol....i lost my sister, brother in law and nephew to drunk drivers.....i have no sympathy for drunk drivers....bikes and lawn mowers?....seems a little harsh....i designate myself as the driver when my friends are drinking to excess......if your family/life has been impacted by drunk driving you understand...sitting between your mother and father at a funeral...holding them both up as they cry....is no place to be....please dont drink and drive...

True, the danger with cycling drunk in public is obvious. On your own property you might just fall up and mess yourself up which is your own business. I dont think he was riding it though, which is why its so stupid. The rise of the police state eh. You are free to let us micromanage every aspect of your life. Police should have common sense it obvious he wasnt a danger to anyone, but police have quotas and if there aren't enough criminals out there you can be sure they will make them!! :)

I was right there with you, up until you started to justify abolition of drunk motor vehicle driving laws. I agree, laws prohibiting drinking of driving a lawn mower bicycle or golf cart on private property are wrong, but laws against driving a car drunk are not, and no amount of justification with numbers will change my mind about that. It's sort of like justifying a repeal of flu research because so few people die from flu compared to cancer. We can mitigate DUI deaths easier than flu deaths.

when you compared drunk driving with speeding, you made a great point. I mean, let's be fair. Why not just do an umbrella punishment and not single out drunken drivers since speeders cause just as much harm/accidents/damage.

Actually, driving with alcohol in your blood is a step removed from speeding. Speeding is dangerous. Speeding IS driving unsafely- thats the risk created. Alcohol in blood on its own isn't dangerous. It creates a risk of creating a danger. It increases the risk of a driver being incapable of driving safely, and driving unsafely is the risk. if that made sense Speeding = unsafe --> endangering others = punishment DUI--> risk of driving unsafe ---> driving unsafe --> endanger others = punishment

No. I'm very obviously comparing Jim Crow to the Holocaust in order to demonstrate the stupidity of your argument that simply because something is really bad somewhere else it is OK if it's just a little bad here. Charging somebody with a crime simply for walking his bike across his lawn after having a few beers is not justified by the fact that it might be even worse in Germany.

there should be rules set in place to "unF*ck" people like yourself. Totally agree that you were done wrong in all possible ways.
But the second they say its ok to drink and drive, how many accidents are going to happen? its like saying speed limit is 55 and everybody goes 70. if u tell them they can go 70 they will go 100. u know what i mean??
